Acceptable Use And Terms of Service

      Megamallandmall.com's services may only be used for lawful purposes. Transmission of any material in violation of International, Federal or State regulation is prohibited. This includes but is not limited to: material legally judged to be threatening or obscene, or material protected by trade secret laws.
      If you are found in violation of Megamallandmall.com's Acceptable Use and Terms of Service your account will be terminated without notice and you will forfeit all of the monies that have been paid to Megamallandmall.com.
      Examples of content that is not acceptable on Megamallandmall.com's Servers: "Pirated software" or "Warez", "Hacker programs and/or archives", "IRC Bots", "Chat software", "Gambling Related", "Copyrighted Mp3's", "Copyrighted software".
      You specifically agree to indemnify and hold Megamallandmall.com harmless from any claims resulting from a breach of these terms, and/or their use of the service, which damages another.
      Warez includes pirated software, ROMS, serials, emulators, phreaking, hacking, password cracking, IP spoofing, etc., and encrypting of any of the above. Also includes any sites which provide "links to" or "how to" information about such material.

Forbidden practices
      The following practices are forbidden on our servers and will result in immediate cancellation of an account without a refund:
      Reselling account space for normal accounts.
      Spamming, or the sending of unauthorized commercial emails is prohibited. Users found to be spamming will be removed immediately and charged a $500 service fee. Matt's FormMail is not allowed on the servers as it is a commonly abused script for spammers. You can download a secure form script by clicking here.
      Representing yourself as an employee with Megamallandmall.com or representing your site as owned or operated by Megamallandmall.com

Limitation of Liability
      All conditions, terms, representations and warranties relating to the Services supplied under this Agreement, whether imposed by statute or operation of law or otherwise, that are not expressly stated in these terms and conditions including, without limitation, the implied warranty of satisfactory quality and fitness for a particular purpose are hereby excluded.
      Our total aggregate liability to you for any claim in contract, tort, negligence or otherwise arising out of or in connection with the provision of the Services shall be limited to the charges paid by you in respect of the Services, which are the subject of any such claim.
      In any event no claim shall be brought unless you have notified us of the claim within 6 months of it arising. In no event shall we ever be liable to you for any loss of business, contracts, profits or anticipated savings or for any other indirect or consequential or economic loss whatsoever.

Billing
      At this time we provide invoices, when you sign up for a hosting plan you will be billed a yearly fee. This is done automatically, and makes retaining your web hosting service easy and automated. You have 10 days from the original due date to pay before your hosting account will be terminated.

Extra Charges
      We have no setup or hidden fees. There are however extra charges if you go beyond your hosting plans' Disk Space or data transfer allowance. There is a charge for each 100 Megabyte of Data Transfer over your hosting plans' data transfer allowance. There is no need to worry about this extra fee, as most customers do not go over their hosting plans' data transfer allowance. If you feel you might go over your data transfer allowance then you can always add additional data transfers to your hosting plan for just a few dollars more a year.
There is an addtional charge to have Secure order form/SSL Installed on your Domain

Refusal of Service
      We reserve the right to refuse, cancel, or suspend service at our sole discretion.

Use of Web Space
      Plans cannot be abused for storage of files not linked to or related to the domain on the account. Web space is not to be used to resell hosting to others, and using the service for this purpose is abuse of the service and the account will be cancelled. Software downloads, MP3's, video, audio, etc. are allowed, but accounts that exceed their amounts of server resources and disk space may be subject to additional charges. We will always warn the account holder before adding additional charges or canceling such an account, unless they are found to be hosting unacceptable content, in which their account will be cancelled immediately.
